Sparkul AI Agency LLC ("Sparkul," "we," "us," or "our") provides AI-native marketing and growth services to businesses ("Clients"). This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. It applies to our website at https://sparkul.ai (the "Site"), and to the software, agents, and services we operate on behalf of our Clients (the "Services").

By using the Site or Services, you agree to this Policy. If you do not agree, please do not use the Site or Services.

Who this Policy covers

• Site visitors who browse sparkul.ai or submit our contact / scorecard forms.
• Clients — businesses that engage Sparkul to run marketing on their behalf.
• End users of our Clients — for example, a person who fills out a Client's lead form, or whose interaction with a Client's ad, listing, or review we process while delivering the Services.

Information we collect

Information you provide. Contact details (name, email, phone, business name) you submit through our forms; the contents of messages you send us; and information a Client shares with us to set up and run their account.

Marketing-platform data. When a Client authorizes us, we access data from their connected marketing platforms — including Google (Google Ads, Google Business Profile, Google Analytics/Search Console) and Meta (Facebook and Instagram advertising and business assets) — solely to deliver the Services to that Client. This may include campaign performance, ad account settings, business listing information, reviews, and aggregated audience metrics.

End-user / lead data. When we operate a Client's funnel, we process information about that Client's leads and customers (such as name, contact details, and inquiry content) in order to classify, respond to, and report on those interactions on the Client's behalf.

Automatically collected data. Standard log and device data (IP address, browser type, pages viewed, referring URLs) and cookies or similar technologies on the Site, used for security, analytics, and to improve the Site.

How we use information

We use information to:

• Provide, operate, and improve the Site and Services;
• Deliver marketing work for Clients — including running and optimizing campaigns, drafting responses, monitoring visibility, and producing reports — always under human review for any action that sends, spends, or publishes;
• Respond to inquiries and provide support;
• Maintain security, prevent fraud and abuse, and comply with law;
• Measure and report outcomes to the relevant Client.

We do not sell personal information, and we do not use it for advertising unrelated to the Client on whose behalf it was collected.

Google user data — Limited Use

Sparkul's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements. We access Google user data only to provide or improve the specific Services the relevant Client has authorized, we do not transfer or use it for serving advertisements, and we do not allow humans to read it except with the Client's consent, for security, to comply with law, or as required to operate the Services.

Meta / platform data

Data we access through Meta's platforms is used only to deliver the authorized Services to the Client who owns the relevant business assets. We handle it in accordance with Meta's Platform Terms and applicable developer policies, and we retain it only as long as needed to provide the Services or as required by law.

How we share information

We share information only as needed to run the Services and the business:

• Service providers / sub-processors who help us operate, such as cloud hosting and database (Supabase), model and AI providers (Anthropic, OpenAI, Perplexity), messaging and email delivery (Twilio, Resend), workspace and documentation tools (Notion), and search/data providers — each bound to use the data only to provide services to us.
• The relevant Client, for data we process on their behalf.
• Legal and safety — when required by law, to enforce our terms, or to protect rights, property, or safety.
• Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy.

Data retention

We keep information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Client and end-user data is deleted or returned at the end of an engagement on request, subject to legal retention requirements.

Security

We use administrative, technical, and organizational safeguards designed to protect information, including least-privilege access, per-Client credential scoping, and encryption in transit. No system is perfectly secure, but we work to protect the information entrusted to us.

Your choices and rights

Depending on where you live, you may have rights to access, correct, delete, or port your personal information, or to object to or restrict certain processing (for example under GDPR or the CCPA/CPRA). To exercise these rights, contact us using the details below. For data we process on behalf of a Client, we will refer your request to that Client as the controller of the data. You can opt out of non-essential cookies through your browser settings.

Children's privacy

The Site and Services are not directed to children under 16, and we do not knowingly collect personal information from them.

Changes to this Policy

We may update this Policy from time to time. We will post the updated version here and revise the "Effective date" above. Material changes will be communicated as appropriate.
